Terms and Conditions for Nu Business Solutions

By attending a meeting, paying for or receiving service or engaging with Nu Business Solutions, you agree to these Terms and Conditions. These terms supersede any verbal communications and can only be superseded by a mutually signed and agreement by a majority owner shared through the company’s formal document signing platforms.

1. Acceptance of Terms

By accessing or using the services offered through and by NuBusinessSolutions.com (the "Website"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Website.

2. Scope of Services

The Website provides various business consulting services, including administrative, marketing, management, public relations support, bookkeeping, payroll, accounting, human resources, and business development. Detailed descriptions of the services offered are provided in the specific Scope of Work.

3. Confidentiality

We respect your privacy. The Website will keep confidential all non-public matters discovered during the engagement, except when there is implied authorization, a waiver by the user, or as required by law or ethics.

4. User Obligations

You agree to provide accurate, current, and complete information about yourself as prompted by the Website. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. You must actively participate in your own case by providing timely and comprehensive information, responding promptly to communications, and engaging in meetings and decision-making processes.

5. Marketing Services

By using the Website, you authorize us to use any written, audio, or video testimonials you provide for marketing purposes. You also consent to the use of non-confidential project details for marketing.

6. Timelines

The Website has the discretion to set deliverables according to reasonable negotiated Scopes. The Website is not responsible for timelines extended because of third-parties, stalls, abandonment or clients failure to provide meaningful support to advance Scopes.

7. Meetings and Scheduling

The Website may offer scheduling tools for arranging meetings. You agree to use these tools responsibly. A 24-hour cancellation policy applies to last-minute cancellations, and fees may be charged for repeated cancellations. You must prioritize and actively participate in scheduled meetings to ensure project progress.

8. Stalls and Abandonment

Inactivity due to a lack of response from you will be considered a Stall if it lasts less than 30 days and Abandonment if it exceeds 30 days. Re-engagement fees may apply for abandoned projects. The Website may temporarily file or archive data from abandoned contracts and charge fees for the storage of data. User retrieval of data is contingent on payment of any storage fees. After six months, the Website may destroy copies for data security.

9. Submission Requirement

It is your responsibility to provide information and easily understandable written content where needed to inform the direction of the project in advance of the commencement of a Scope. NuBusinessSolutions.com-authored content is charged at the billable hourly rate. Third-party proofreading is required. You are responsible for providing timely feedback to progressively and substantively advance the project.

10. Logos, Graphic Designs, and Video Post-Production

You will receive the first round of design concepts via a project management task notification after NuBusinessSolutions.com receives the marketing self-assessment and direct requests or Designer's Choice approvals.

11. Renderings and Revisions

A rendering is the graphic interpretation of a project Scope. A revision is a non-substantive modification as defined by the graphic designer to an existing rendering, including a change to the background, shading, coloring, or spacing. A substantive change to the rendering or the project Scope is considered a new rendering or a re-rendering request payable/due upon request.

12. Revisions and Re-rendering

Three revision cycles are included free of charge. The free revision period is seven days from the date the initial rendering is sent and includes all three cycles. During the free revision period, you are expected to actively engage in the process, respond to the presentation of logos, mockups, graphic designs, presentations, videos, and web design services in writing with all revisions. There are two options to approve Scopes: 1) Do nothing and the submission will stand with automatic approval after three days. 2) Report “approved,” “approved with modification,” or “request changes” before the seven-day period ends. Regardless of the cycle, revisions requested after the seven-day period are charged at the regular rendering and editing rates. Requests for additional rounds of revisions are payable at the time of the request. Re-renderings are charged and payable at the normal prevailing company design rates.

13. Web Hosting

Webmaster service agreements come with one year of free website hosting. Web hosting includes installing and maintaining your website on our servers for online accessibility to the public. Service renewal is payable 30 days prior to the renewal date. Annual renewal notices and invoices will precede the renewal.

14. Webmaster Services

Webmaster service agreements include regular maintenance and updates to your platform, theme, and plugins. Some plans include allotted hours for design changes. Note: Sometimes updates may disrupt the website. When that happens, you may opt to roll back to a previous working version or move forward with the upgrade, making necessary website updates. Website changes in conjunction with upgrades are new scopes of work and will be quoted and payable as such under this agreement. You bear all responsibility for disruptions, upgrades, or issues that arise from website changes made by you or your designees. Website maintenance required because of client-side access changes are new scopes of work and will be quoted and payable as such under this general agreement.

15. Hacking Recommendation

Governments, financial institutions, and major businesses with advanced monitoring systems have all been hacked. Website hacking is unavoidable. We recommend clients take preventative action by using our advanced Webmaster Service agreements that monitor vulnerabilities more regularly. These precautions cannot guarantee that you will not be hacked since website hacking is unavoidable. The precautions do position you to be more prepared for and responsive in getting your website back online and accessible if or when you are compromised. By using the Website, you acknowledge this reality and accept all responsibility for implementing preventative and restorative solutions at the quotable rates.

16. Social Media Marketing, Email Marketing, Promotion, & Digital Advertising

When authorized, the Website can engage in sales, advertising, lead generation, and client recruitment activities on your behalf. You understand that all strategies, concepts, and implementations are experimental. Though the Website will recommend best practices given available information and tools, advertising and lead generation results are based on several factors (including budget, market saturation, messaging, marketability, targeting, customer service, reputation, ever-changing advertising platform standards & algorithms, and other factors). As such, results are not guaranteed. You agree to move forward understanding the risks of advertising and promotion. The service fee is for the deployment of said activities and not for the outcomes of the strategies.

17. Refunds and Disputes

Refunds are not provided for retainer payments once work has begun. Any disputes regarding billing or services must be raised within seven business days of the concerning issue. If unresolved within seven days, approval of the charges is implied.

18. Claim Limitation

Any claim or cause of action arising out of or relating to the use of the Website must be filed within one (1) year after such claim or cause of action arose or be forever barred.

19. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

20. Cash Advances

NuBusinessSolutions.com does not advance funds for services of the Website or third parties. You understand that retainers are for contract management and service delivery only. Additional funds must be made available for expenses, taxes, liability payments, and other approved third-party services.

21. Files and Records

NuBusinessSolutions.com will return all of your original client files and materials to you or provide an opportunity to retrieve your original client materials immediately upon the conclusion of the representation. If you do not pick up your original client materials within six months of receiving notice that they are available, they may be destroyed without further notice to you. If you owe more than $100, NuBusinessSolutions.com may refuse to turn over your file.

22. Breach for Non-Payment

In cases where services are rendered on credit because of insufficient funds or payment issues, services on credit have a 17.3% surcharge plus any applicable credit card processing fee. Payment for services on credit is due upon receipt. An interest rate of 7% per year, non-compounded, is applied to all balances not paid within 30 days of billing. The Website reserves the right to suspend services until account balances are current. The Website reserves the right to cancel all applied discounts when an account is in default for non-payment.

23. Refunds and Disputes

Refunds are not provided for retainer payments once work has begun. Any disputes regarding billing or services must be raised within seven business days of the concerning issue. If unresolved within seven days, approval of the charges is implied.

24. Claim Limitation

Any claim or cause of action arising out of or relating to the use of the Website must be filed within one (1) year after such claim or cause of action arose or be forever barred.

25. Subject to Change

The Website reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Website. You agree to be bound by any current and future terms with regard to the Website, Services, or Scopes.

27. Files and Records

29. Right to Terminate

The Website reserves the right to refuse or terminate services if your activities are deemed illegal, deceptive, immoral, or otherwise unacceptable. Refunds for terminated services will be provided less any fees for work already completed.
